$505,000 Settlement in Illinois Truck Accident Case: When the Defense Claims the Crash Was Too Minor to Cause Injury

Not all injury cases turn on who caused the crash. In many Illinois truck accident cases, the dispute is whether the crash caused the injury at all. In some truck accident cases, the defense argument is predictable: The collision was too minor to cause real injury.

That argument was made in one case handled by our firm. It did not hold up. The crash involved a commercial truck that moved into the plaintiff’s lane, making contact along the side of the vehicle as both continued traveling. There was no dramatic impact. No crushed vehicle. Nothing that looked serious at first glance.

But that is not the issue.

The issue is not how the crash looked, but whether the forces involved can explain the injuries that were diagnosed.

Following the collision, the plaintiff was diagnosed with lumbar disc injury and thoracic outlet syndrome—conditions involving both structural damage and neurological compression. Thoracic outlet syndrome involves compression of nerves or blood vessels between the collarbone and first rib, often resulting from force transmitted through the shoulder.

The defense focused on the absence of visible vehicle damage. Experts were prepared to argue that the forces involved were comparable to everyday movement. But that analysis ignored the actual mechanism of the collision—specifically, the sustained lateral contact and the transmission of force through the torso and shoulder.

The case turned on medical evidence and whether the injuries were consistent with the forces involved—not whether the crash appeared severe.

The case resolved for $505,000.

These cases are common in Illinois personal injury and truck accident litigation, where the severity of the crash is often disputed. They are not decided by how a collision looks, but by whether the injuries can be explained by what actually happened.
